INTRODUCTION
Welcome to MBF Career NeuroCoaching. MBF Career NeuroCoaching is a service that helps people identify their ideal career and/or prepare for a career transition, whether within the corporate world or into entrepreneurship. It also helps organizations maximize the talent of their human resource. The terms and conditions here established represent a contract/agreement between the Client and MBF Career NeuroCoaching. By accessing and using this website and/or MBF Career NeuroCoaching services, you affirm that you have read and understood these Terms and Conditions, as well as our [Privacy Policy] and accept them.
SERVICE USE
Customers must be at least eighteen (18) years of age in order to use the website and our services. By using this website and our services, you affirm that you are at least 18 years of age and have the ability to comply with these terms. You also affirm that you will use the website and our services in a manner consistent with any and all applicable laws and regulations. MBF Career NeuroCoaching may end this Agreement and your use of this website and our services at any time without notice if we believe you are under the age of 18 or otherwise violate this agreement. In the case of children under 18 years of age, the service will be processed through the parent or legal guardian.
TIME
The duration of each session will be in accordance with the provisions of the coach-client contract and will be carried out according to the schedule that has been established for each appointment. Sessions can be face-to-face (depending on the location of the client), by phone, or videoconference. The minimum suggested time for the adult/professional coaching process is 3 months (1 session per week) as it is a reasonable period to start developing a proper plan and address preliminary or final results. In the case of Career Selection for students, the process consists of a service package handled in a much shorter period of time, and the duration of the sessions is different. RESULTS
The time needed to obtain results will vary according to the client, their needs, and their proactivity in the coaching process. The results of the analysis do not show a single career or business choice, but several alternatives. The client is who makes the final decision.
CANCELATIONS
If you have to cancel an appointment already scheduled, you must notify it 24 hours in advance. This is because that time that was set aside for you is time that could have been spent on another customer who needed the services.
EMAIL SUPPORT
If you need to speak with the coach before your next session because you have any questions or queries you want to ask, you can contact the coach via email and your request will be answered in writing, as long as it is a simple query. If it is a more complex matter, another session should be scheduled at your convenience.
ENTREPRENEURSHIP
In case the client wants to start a business, general guidance is provided, but the person will be referred to other sources for more specific information and is required to contact an attorney and/or accountant (CPA) for additional/important business and legal details.
TESTIMONIALS
MBF Career NeuroCoaching may request your permission to post any positive testimonials offered by you for marketing purposes. This will be done in writing and with your consent.
PAYMENTS AND FEES
If you purchase any of our career services, MBF Career NeuroCoaching will charge the full price of the service in accordance with the established price conditions. Payment for MBF Career NeuroCoaching services must be paid in advance at the time of scheduling your coaching session to reserve your space and is charged before our work begins. In the event that a package of services has been purchased, payment will be made in accordance with the provisions of the coach-client contract agreed upon. MBF Career NeuroCoaching is not responsible for any charges charged to you by your bank in connection with our payment collection. You agree to pay MBF Career NeuroCoaching for any services purchased using one of the payment methods described in the agreement sent by email once you decide to start the service. Refunds, if any, are at MBF Career NeuroCoaching's entire discretion and will be in the form of a credit for MBF Career NeuroCoaching services or a cashback refund. MBF Career NeuroCoaching reserves the right to determine how the refund will be given. If a coaching session is canceled without the 24-hour prior notice, payment will not be refunded but credited for a future session. In the event that MBF Career NeuroCoaching terminates this agreement for your non-compliance with this agreement, you understand and agree that you will not receive any refund or exchange for any unused time in any package or for fees for any part of our services, or for anything else.
SERVICE EXPIRATION
All services purchased must be redeemed in the number of days established in the coach-client contract for the purchase of each service. If you do not get in contact with us within the established time period, your purchased services will be considered void without refund.
CUSTOMER CONTENT
You are responsible for any comments, photos, videos, graphics, and other content you submit or upload to the MBF Career NeuroCoaching website. You may not upload to the website any material protected by copyright, trademark or any other proprietary right without the permission of the owner. You will be solely responsible for any damages resulting from any content you provide and agree to pay all royalties, fees, damages, and any other monetary debt to any person due to any content posted by you through our website. We also reserve the right to remove any negative or indiscreet comments from you that you post on our blog.
INTELLECTUAL PROPERTY
The website, services, and every other material contained in it, including text, graphics, patents, logos, trademarks, branding, audio, videos, music, and any other content, are property of MBF Career NeuroCoaching. You agree to not edit, copy, reproduce distribute, transmit, sell, publish, or plagiarize any content pertaining to the website. MBF Career NeuroCoaching is a commercial brand used by us to identify our website, business, and service in a unique way. You accept to not use this commercial brand anywhere without our previous written consent.
NON-AUTHORIZED ACTIVITIES
You understand and agree that you will not violate any laws or regulations; hack, crack, phish, SQL inject, or interfere with the integrity of our website’s computer systems, service or customers; publish false information, whether about a job, a company, or your own credentials as a job seeker; or act in a manner that, at MBF Career NeuroCoaching's discretion, is inappropriate. On the other hand, MBF Career NeuroCoaching does not provide any guarantees against viruses, malware, or spyware that may be installed on your computer.
LINKS TO THIRD PARTIES
This website may contain links to third-party websites, advertisers, services or other events or activities that are not owned by MBF Career NeuroCoaching. MBF Career NeuroCoaching assumes no responsibility for these third parties. If you access a third-party website, you do it at your own risk and understand that this agreement and our privacy policy do not apply to your use of such third parties. You release MBF Career NeuroCoaching from any liability, loss, or damage arising from the use of such third-party sites or services.
RESPONSIBILITY LIMITATIONS
You acknowledge that MBF Career NeuroCoaching is not responsible for your professional decisions. You agree that the coach has no responsibility for the results that derive directly or indirectly from the coaching process. You acknowledge that you are fully responsible for the decisions you make and the results they bring with them. Moreover, MBF Career NeuroCoaching has no control neither over hiring processes/decisions, nor over the veracity of the content submitted by clients regarding resumes, LinkedIn profiles, etc. You acknowledge and agree that you are completely responsible for the correctness of any content generated that you submit to any company or interviewer. You agree to indemnify MBF Career NeuroCoaching from any payments, liabilities, costs, debts, or expenses (including, but not limited to, attorneys' fees ) arising out of or any claims, especially if it comes from your violation of these terms and conditions and or any third-party rights. If MBF Career NeuroCoaching is, by a justified reason, liable for any damages, regardless of the cause of action, the amount MBF Career NeuroCoaching will pay will never exceed the total amount you have paid to MBF Career NeuroCoaching.
APPLICABLE LAW AND FORUM IN THE EVENT OF LEGAL DISPUTES
In the event of any claim, action or dispute arising out of or relating to this agreement, it shall be governed by the Commonwealth of Puerto Rico laws, by a state or federal court in the city of San Juan, Puerto Rico, unless otherwise agreed by the parties, regardless of the country or city where the claim or dispute originates.
GENERAL
If any provision of this agreement is held invalid by any court of competent jurisdiction, such statement shall not affect the validity of the remaining provisions of this agreement, which shall remain in full force and effect.
CHANGES
MBF Career NeuroCoaching may make changes to the content and features of the website and services at any time, with or without notice. MBF Career NeuroCoaching may change or update this agreement at any time and without notice by posting the updated terms of use on www.careerneurocoaching.com. If you do not agree to any of the updated terms, you must stop using the website and services immediately and no refund will be provided.
NOTICES
MBF Career NeuroCoaching may send you notifications for any purpose related to the service or business through email, text message, phone call, regular mail, written or hard copy notice.
